the users of this platform designated in § 2 of these General Terms and Conditions – hereinafter referred to as the "Customer" –.

I. SCOPE OF APPLICATION
All deliveries, offers, and services are provided exclusively subject to these General Terms and Conditions.
By placing an order, the Customer agrees to these General Terms and Conditions and is bound by them. Conflicting or deviating provisions require the express written consent of both parties.

II. CONCLUSION OF CONTRACT
The contract becomes legally binding when the Customer submits their order and receives an order confirmation from the Provider.

III. DELIVERY TERMS
Goods are delivered as soon as possible after receipt of payment in the specified account. Delivery times for custom-made items may vary depending on order volume but generally range from a few days to two weeks following receipt of payment. hoss Mobility GmbH assumes no liability for delivery delays or other faults attributable to the shipping company. The Customer shall bear all costs arising from incorrect, incomplete, or unclear information provided by them.

IV. PAYMENT TERMS
All prices are quoted in Euros. Payment must be made in advance within 7 days of ordering the item. If no payment is received within 14 days and no contact has been made, the claim to delivery lapses. Personalized goods (custom-made items such as armrests, footboards, etc.) are manufactured only after receipt of payment.

V. PLACE OF JURISDICTION AND PLACE OF PERFORMANCE
The company's registered office is agreed upon as the place of jurisdiction and place of performance. Austrian law applies exclusively.

VI. RETENTION OF TITLE
The goods remain the property of the seller until the purchase price has been paid in full.
All items are created based on original ideas and designs and are therefore protected by copyright. Consequently, they may not be copied, modified, or otherwise used for commercial purposes.

​

 

VII. QUALITY/DESCRIPTIONS
All items offered are handmade and therefore unique pieces. Minor irregularities are an inherent characteristic of handmade goods and do not constitute defects.
All offers are non-binding and valid only while stocks last.

​

 

VIII. FORCE MAJEURE
In the event that the provider is unable to render the owed performance due to force majeure (specifically war, natural disasters), they shall be released from their performance obligations for the duration of the impediment.
If the execution of the order or delivery of the goods is rendered impossible for the provider for a period exceeding one month due to force majeure, the customer is entitled to withdraw from the contract.

IX. DATA PROTECTION
The customer consents to the automated storage and processing of data received in connection with the order by the provider for the purpose of fulfilling this contract. Customer data is treated confidentially and not passed on to third parties.
We reserve the right to charge a surcharge for additional costs arising from changes made after order acceptance.
